House Bill 4121 Enrolled

House Bill 4121 directs the OLCC to establish a registry for hemp items (sections 10-17, 2024). This rulemaking is being undertaken to implement these statutory requirements. All industrial hemp items that contain cannabinoids and are intended for human or animal consumption must be registered with the OLCC. Examples include hemp pre-rolls, tinctures, and edibles like a gummy. The requirements apply to hemp items being sold to Oregon consumers, either online or in brick-and-mortar locations like a gas station or grocery store. The registry’s requirements do not apply to marijuana.

Among other things, the bill requires certain labeling requirements and directs OLCC to implement additional labeling requirements by rule. It also requires the submission of a certificate of analysis of the batch or lot of hemp item being registered. Additionally, the bill prohibits hemp items from being adulterated. The OLCC has modeled many of the hemp registry labeling requirements after existing requirements in the OLCC-licensed marijuana market.

These requirements are effective on January 1, 2026, and registrations must be renewed annually. The OLCC is undertaking rulemaking before this date to receive feedback from the hemp industry as well as provide advanced notice to those affected by the law and rules.
